ToughBuilt Limited Lifetime Warranty*

While every ToughBuilt product is built to be tough, it is important to use ToughBuilt products appropriately. All ToughBuilt products are protected by our LIMITED LIFETIME WARRANTY against defects in material or workmanship. Normal wear and tear and conditions resulting from accident, misuse, abuse, alteration or improper care or maintenance voids the LIMITED LIFETIME WARRANTY. This warranty is exclusive and in lieu of any other express warranty of any kind.
Parts and Accessories are not covered under this Warranty. All warranty work must be carried out by a Kincrome Authorised Service Agent.

In the event that this product exhibits defects in materials or workmanship (excluding those resulting from abnormal or unwarranted usage), you have the option, at your own expense, to dispatch the product to the address provided above for either replacement or repair. Your entitlements under this warranty are supplementary to any other rights conferred upon you by the Australian Competition and Consumer Act 2010 (Australian Consumer Law), the New Zealand Consumer Guarantees Act 1993, and any other pertinent legislation related to the products covered by this warranty. This warranty:
- Safeguards the product against flaws in materials or workmanship.
- Encompasses the replacement of components, labor for repairs, reimbursement of the product's purchase price, or alternative forms of compensation for the remaining duration of the warranty.

HOW TO MAKE A WARRANTY CLAIM
To make a valid claim under this warranty, you must:
- If fault occurs, fill in a warranty submission form via the Direct Warranty form, or return the product firstly to the place of purchase (or lastly to one of Kincrome's other addresses), with a confirmed register receipt or invoice clearly showing the date of purchase, or contact ToughBuilt Australia Customer Service on 1300 657 528 to troubleshoot or further information; and/or
- Provide Kincrome any further information when requested
You are responsible for all costs incurred by you to return the ToughBuilt Product to Kincrome and all other costs you incur in making a claim under this warranty.
We may also require further information from you in order to process your manufacturer’s warranty claim, such as your contact details which may include the following:
- Name
- Phone Number
- Address
- Email Address
WARRANTY EXCLUSIONS
Each ToughBuilt Product is designed and manufactured for a specific purpose. Kincrome warranties on ToughBuilt products does not cover and/or will also not apply if:
- The Product fault, failure or damage is caused as a direct result of any repairs to the Product are made or attempted by a service provider other than an authorised service agent approved by Kincrome.
- The Product is subject to normal wear and tear. Wear and tear due to excessive use. Parts including, but not limited to bearings, seals and O rings must be regularly inspected so that the wear and tear on such parts do not lead to failure of the tool.
- Accessories and/or consumables including, but not limited to blades, wheels.
- The Product has not been used or maintained in accordance with the manufacturer’s instructions as provided with the Product.
- The consumer uses the Product in an abnormal manner for example if the Product is abused, misused, dropped, crushed, impacted with any hard surface, exposed to extreme heat (including fire) or cold, not maintained properly or used after partial failure.
- Damage to the Product is caused by sand, water damage, rust corrosion, fire, vermin and/or insect infestation, power outages or surges, or inadequate or improper voltage or current.
- The Product has been modified, incorrectly adjusted or operated or used with inappropriate accessories.
- The Product is tampered with in any way or if the damage has been caused by an extraordinary event or circumstance beyond the control of the consumer or Kincrome Australia Pty Ltd.
- The Product was purchased from a non-authorized ToughBuilt retailer in Australia or New Zealand including, but not limited to eBay, Amazon and Facebook marketplace.
- The product is used for an inappropriate application.
CONSUMER GUARANTEES
The benefits provided to the consumer in this warranty are in addition to other rights and remedies of a consumer under the Australian Competition and Consumer Act 2010 (Australian Consumer Law), the New Zealand Consumer Guarantees Act 1993 and any other laws in relation to the products to which this warranty relates. This warranty:
- Covers the product against faulty materials or workmanship; and
- Covers the replacement of parts, the repair labour used, a refund of the price of the product or other compensation for the remainder of the warranty period.
